Last week, Gov. Garcia Padilla ordered the sale of more than 350 school buildings throughout Puerto Rico. He did this though an “executive order” that was not disclosed for six days…then quietly announced on Black Friday, the day after Thanksgiving.

But the problem is even deeper than 350 schools. The governor’s statutory language will now empower him – and incoming governor Ricky Roselló – to sell ALL the public assets of Puerto Rico, whenever they see fit. Here is how they’ll do it… 

EXECUTIVE ORDERS

An executive order is a powerful weapon. With the stroke of a pen, a governor can create a mandate which is immune to legislative veto…and little, if any, public review.

That is what exactly what Gov. Garcia Padilla did on Nov. 19, with Executive Order 2016-046, which authorized the private sale of over over 350 public schools.

But now, through Law 12 of Dec. 10, 1975, the government of Puerto Rico will be authorized to sell ANY AND ALL of the public assets of Puerto Rico.
 

 
LAW 12

Law 12 empowers the Puerto Rico Secretary of Transportation and Public Works to sell “any property of the Commonwealth of Puerto Rico which ceases to be publicly useful.”

This language appears on the first page, in the very first “Por Cuanto” clause (“Whereas” clause) in the governor’s executive order to sell the 350 schools.

EVERYTHING IS NOW FOR SALE

Thanks to this Law 12, enacted 41 years ago during the administration of Rafael Hernández Colón, a governor may order the private sale of public property, which is deemed to be “unproductive” or “not publicly useful.”

Unfortunately – with Puerto Rico allegedly “in debt” for $72 billion, and a U.S. Financial Control Board in place to collect it – the next governor could declare half of Puerto Rico to be “unproductive,” then sell the island’s public assets to Wall Street.

This includes pieces of PREPA (the electrical grid), PRASA (water and aqueducts), schools, highways, bridges, hospitals, airports, prisons and public housing.

The mayor of Toa Baja did this – selling the CDT (Centro de Diagnostica y Tratamiento) Hospital – and the city government still had to shut down, for complete absence of funds.

And so, very possibly, the sale of Puerto Rico’s public assets may benefit no one, except the private buyer who acquires those assets at bargain prices.

THE NEED FOR VIGILANCE

Mercedes Martínez, the president of Federación de Maestros (the Puerto Rico Teachers Union) has already released a strongly-worded press release, condemning Garcia Padilla’s “Machiavellian” maneuver to sell off 350 public schools.

Rep. Guillermo Miranda Rivera, the incoming Education Chair in the Puerto Rico Legislative Assembly, announced a pending investigation of the governor’s order (OE-2016-046) to sell 350 public schools.

But this situation will recur again and again…particularly with an incoming PNP governor who has repeatedly declared his support for “public-private partnerships” throughout the island.
 

 
In fact, in the pages of Forbes magazine, Ricky Rosello has announced that “Puerto Rico is addicted to spending” and “it’s these public-private partnerships that will provide long-term repayment guarantees to bondholders.”

The executive discretion of Law 12, the coercive power of the Financial Control Board, and the “cooperative” signals from governor-elect Roselló, all indicate a dangerous era for Puerto Rico…in which enormous pieces of its public infrastructure might be sold away forever.

Attention must be paid.

  2. Previous government oversight of Puerto Rico assets have resulted in the country being driven into bankruptcy. Governments do NOT know how to run businesses at a profit. There are few choices to move the country out of debt and into the future. Privatization of certain assets is not as horrible as it sounds. Look at past privatization to see the possibilities for the future of Puerto Rico. The country has previously sold off the telephone company and the airport resulting in lower comparable telephone rates (as in the US) and new upgrades and expansion to the airport. If we privatize certain assets that will attract much needed outside investment capital resulting in upgraded ultilities and much needed alternative energy investments which will translate into competive lower rates.
    Example: PREPA alone has some $9 billion in debt and needs $6 billion in new capital to upgrade its grid. The only choice is to privatize PREPA which will allow for sizable outside investment. Outside capital will also lead to job creation and increased productivity.
    As far as the selling of the 350 schools goes since they are already closed its makes sense to sell them to companies who will create new businesses and create jobs.
    I strongly believe Puerto Rico should keep its independence. Ask yourself this question: Are you better off being part of the solution to eliminate our $70 billion deficit which is difficult but fixable or part of the US $20 TRILLION dollar debt which will never be fixed.

This the same crap the elites have been doing for hundreds of years, get it in debt then bully it for pay back, I’m heartsick that our own people are allowing this to be so mainstream you give away our island, This is a horrible horrible day. What can we do to stop this in the bud before it becomes a reality

    My people our island is being destroyed right before our eyes. Colonialism is what it is – an ugly bondage. It is 2016 and our island is still suffering from colonialism. If the Bully will never let Puerto Rico become the 51st state because of all the money it will lose, then Independence is the only option. The Bully boasts so much of freedom, then show her that you WANT and are ENTITLED to that freedom which she boasts so much about. Be strong and resilient, show the evil and corrupt politicians of the island that you deserve better. Let us fight and be heard. We owe it to our beautiful island which has been battered for so long. Don’t let our island continue to be the battered spouse of the Caribbean. It’s a very sad way to describe our island and my heart aches to hear that expression. May God and man have mercy on my beautiful island.

  6. What is not surprising, is that you can always find people to finish distroying a country or a island , but this not just any island it’s Puerto Rico , in my naive heart I thought I will never see a Puerto Rican part of the same team that is bleeding this island out.

    I’m coming to under stand if your enemy strikes you in a violent fashion and you do not return the same in your defense then you become a slave to this assault. We Puerto Rican’s need to except the fact that the United States will never do the right thing we need to stop waiting for this to happen, people on the main land are doing the same , they are waiting for someone to make America great agin, are we all becoming complacent fools to think that a government will care for its people , we must care for each other if not we will become slaves to these systems designed to oppress not to build for a brighter future for all

  9. The situation in Puerto Rico lies in the fact that their leaders have failed them in more ways then one. Being such a small Island how do you accumalate so much debt ? Puerto Rico desperately needs an overseer to manage it’s affairs and to make sure that the mis-management of so much borrowed money, will never happen again. That is why Statehood for Puerto Rico will be in the best interest because it would allow an accountability.

  11. Seams like a give n take for the corruption due to peasants running/stealing from its people. Fidel Castro w believed that Puerto Rico should seek severity and be free of any and all possession of any nations. I don’t agree with the way he or his brother runs the cuban county but we might have had a better infrastructure. Sell it! Sell it all! Our culture n custumes have all been perverted by our own people any way, what happened to the old traditions like three kings day? Now its SANTA CLAUSE.see what i mean ,it doesn’t $

  15. Puerto Rico is not addicted to spending it is addicted to being mugged since 1898. And the United States laws sanctions the mugging of Puerto Rico. If they refuse to be mugged they will be arrested and tortured like they did to Don Pedro Albizu Campos and the Nationalist movement. The people have two choices be mugged or face jail and torture. GREAT CHOICE !!!

  18. I went to school in Puerto Rico when I wàs 8. I was raised speaking Spanish, but it helped me alot. Any one who sells schools are totally insane. Did anyone think about where the children are going to after these so called buyers received them? DID THE HURRICANES WAS OUT THEIR BRAIN!
