Puerto Rico must go to the United Nations

The US has just handed Puerto Rico the perfect opportunity…to appear before the United Nations, and demand its complete independence.

It is a gift from Pres. Obama, whether he intended it or not. And there is no way that Obama – or the US government – can argue against it.

THE 1953 “COMMONWEALTH”

In 1953, the US declared that Puerto Rico had achieved “self-determination” and “political sovereignty” through their new Commonwealth relationship with the US.

The United Nations then removed Puerto Rico from the list of countries that were overdue for de-colonization.

But two 2016 U.S. Supreme Court casesPuerto Rico v. Franklin California Tax-Free Trust and Puerto Rico v. Sanchez Valle – have terminated this allegedsovereignty.”

In both cases the Obama administration argued, and the US Supreme Court agreed, that Puerto Rico is a territorial possession of the US: with no legislative, judicial or political sovereignty whatsoever.

In the same week that Sanchez Valle was decided, the US Congress passed the PROMESA bill to impose a Financial Control Board over Puerto Rico, and manage its entire economy.

U.N. RESOLUTION 1514 (XV)

Thus in 2016, all three branches of the US federal government declared that Puerto Rico is a property of the US…a colony.

Given this open declaration from the entire US government, the next governor of Puerto Rico can appear before the UN and invoke Resolution 1514 (XV), which stipulates the right to self-determination of every nation, and the right to reject a colonial relationship.

CHAPTER XI, ARTICLE 73 (B)

In addition, under Chapter XI, Article 73 (b) of the United Nations charter, the US is obligated to the following with respect to Puerto Rico:

 Article 73 (b) “To develop self-government, to take due account of the political aspirations of the peoples, and to assist them in the progressive development of their free political institutions, according to the particular circumstances of each territory and its peoples and their varying stages of advancement.” 

A GIFT ON A SILVER PLATTER

The Sanchez Valle and Franklin Trust cases, and the PROMESA bill, are thus a great diplomatic gift.

If used forcefully before the UN, they provide independence on a silver platter.

The US federal government – all three branches of it – has itself declared to the entire world, that Puerto Rico is not a sovereign entity…but a territorial possession.

A colony.

The elected representatives of Puerto Rico can now appear before the UN, and demand to be de-colonized.

  4. Reading this blog for a while, finally picked up the book and read it. Very well cited and inspirational. I wrote a letter to the UN special procedures about the US commandeering PR government with promesa. Will they consider it? No reason to ask, when I see a man can risk his health and freedom to plant the flag. Will continue!

  5. This could very well be a viable possibility and opportunity for the island to finally stand up and finish what Mr. Campos stipulated decades ago. To be decolonized is to be open for independence with USA’s blessing no doubt. I believe now is the time to seize the moment and act accordingly and decisively. It will never be handed to PR on a silver platter, but rather aggressively taken. With all the division going on the mainland then what better time to act.

  7. We live in a World of injustice and crowded with ignorant and cruel beings !!!!! also many people are humble and wise !!!! For only those ones is my words for the wise and Humble ones !!!! The colony of Puerto Rico is a prize for the USA and they forgot to take care of their property they treat us like slaves with benefits of a false US citizenship . they abuse us with the primitive Jones Act , they laugh at us in Washington and presidents comes and go without taking care of the people of the island . Those people that live in the US and in Puerto Rico that glorify the USA have their own diverse reasons to think they know better . Puerto Rico people will show the wrong doing of the US with our island and people in the UNITED NATIONS . We will get our independence and show the world what slave can do for Humanity . The Us has Drained the Hell out of Puerto Rico,, when you land in San Juan all them Big Hotels and casinos all belong to the Greedy Americans that suck the hell out of the Island..,if Puerto Rico were to be independent… and not let the Moochers in, kick their ass to the curb, shut down their money bags in San Juan,, Puerto Rico would have no problem..Puerto Rico is a Beautiful, Rich, Agricultural Island ,,, I say Puerto Rico Needs to pick their own People to Run Puerto,,and if passports are needed so be it… Puerto Rico needs to take a stand… the Us has screwed the Island over enough.,,,

  9. For all the nay sayers and “criticones” who insist that independence will be the demise of PR, be aware that PIP already has a published transition plan that, if followed by the US and PR, will allow for a healthy economic and social transition to freedom and self determination.
    This is the type of thing that the US proportedly sends it’s citizens around the world to kill and die for. It only stands to reason, one would assume, that this would be welcomed with opened arms by those who say they support freedom, liberty and justice for all.
    Sadly, It appears also that there are those who are adamantly against the prospect of Puerto Rican nationality and would rather be americans (estadounidenses) than Puerto Ricans if faced with that choice. Como decía don Pedro, o yanqui o Puertorriqueño!
    After so many years of colonial manipulation we see the resulting mindset of the classic Stockholm sindrome. The current economic condition while under US rule should be evidence enough that this is not a lucrative or healthy alliance. If this is what the courtship looks like, imagine the marriage !!!

  10. The 118 yr relationship with the U.S. has proven fruitful indeed. But only to the U.S. elites, in the U.S. and their enabler friends on the island. And, where did all of this promised “tutelage” to the islands’ population get them?? Look at them now. Look at them before the invasion. 118 yrs is a lot of time to get things “right” as it related islander welfare. When the U.S. came in and “broke it”, it has always been their responsibility to fix it. 118 yrs to fix it. It got fixed all right. The islanders got placed in a 118 yr old fix.

    This whole thing w/the U.S. Supreme Court, etc.. ALL OF THE SUDDEN REALIZING THAT PR IS A COLONY is bull-shit. This coordinated pronouncement has been in the cards for a long time. Arriving to the 2016 conclusion that PR is a colony now, parlays into something else that’s going to happen that has been rigged. What that’s going to be… who knows.

    The U.N. is going to acquiesce to the U.S.’s desires. How did the U.N. not see through the B.S. back in 1952? Of course they did. And, they’re in on it too.

    Let’s say that everything lines up and PR gets cut loose ( because, really, that’s only when PR will be free; and not by islander “free will” ) and they become independent. What next? Probably nothing good. That’s why the only tenable option has been to fight their way out. Unfortunately, that’s how humankind has encouraged this kind of thing to go down, for thousands of years. Nothing’s changed in that regard.

    The U.S. owes the island so much in reparations, that one might not even to be able to put price on it…much like what was owed to Native Americans; and later on, with the Blacks with slavery. This pay back needs to include a completely free of charge re-do of EVERYTHING the U.S. f**ked up for the islanders. EVERYTHING, and them some. No strings/extended chains attached. Then if the islanders choose to, the U.S. can continue to partner with them in a manner of their choosing. Or not. Then the Dept of Education in D.C. needs to add yet another chapter ( a very contemporary one..) about how it has systematically abused yet another race of people. In real time. The U.S. mainland kids today think that the U.S. has largely moved on from such atrocities. Guess what will happen when they become adults??

The prospect of independence for PR has always been in agenda, but every four years we see how the people prefer remaining a colony in exchange for the USA citizenship and the benefits it entails. If we acquire independence, are we willing to render our USA PASSPORT in exchange for a PR passport? We might even need a visa to travel to USA. Are puertorricans ready for this?

  14. Unfortunately the people of Puerto Rico are not prepared nor haven’t been educated to be independent. About half of the people take some sort of US welfare, others work for US companies or goverment, they are not psychologically ready. The vast majority are bad educated they can’t even speak a correct Spanish as a result of a very deficient educational system, etc.

  18. Too bad there are no “cojones” in Puerto Rico to ensue the only dignified option, independence. Everyone else is living a bad dream and wants to remain in the shackles of that dream. Those who claim statehood as a “dignified” option are simply welcoming and encouraging consenting slavery, the culmination of the colony.

The US has also, with the bill to allow US citizens to sue Saudi Arabia, left the door open for Puerto Ricans to sue the United States for the atrocities perpetrated on them in using them for experiments without their knowledge, the various massacres, etc. This is exactly why Obama vetoed the bill in the first place. It leaves America open to being sued in foreign courts.

  20. PR should take advantage of this and go to the UN and demand decolonization and subsequent independence. PR should do this in an amicable manner by announcing its intent to the US and request their concurrence. In this manner, they can immediately establish diplomatic talks with the US to establish the legal framework for a symbiotic relationship with the US as allies and partners in all political and economic endeavors.
