Tito Kayak and Juan Bobo
A Financial Control Board will soon rule Puerto Rico. The PPD and PNP are trying to privatize the beaches. The minimum wage may drop to $4.25. Instead of law and order, Puerto Rico is swamped with corruption and chaos.
That is why Tito Kayak is so important.
He is a symbol of an UN-conquered Puerto Rico.
For many years, Tito Kayak has walked the walk…taken the risks…gotten arrested…and painted a portrait of what a FREE man looks like.
THE STATUE OF LIBERTY
On November 5, 2000,in protest of the US bombing of Vieques, Kayak (aka Alberto de Jesús Mercado) led five men atop New York’s Statue of Liberty.
With no ropes or safety devices, Kayak climbed out and unfurled the flags of Puerto Rico, Vieques, and two banners that read “Peace” and “Vieques.”
HOW KAYAK GOT HIS NAME
On November 14, 2007, Kayak climbed a construction crane at the Paseo Caribe project in San Juan, and STAYED THERE for a full week.
The San Juan police surrounded the crane 24 hours per day, and collected a lot of overtime pay.
Finally, in a daring escape, Kayak rappelled down from the crane and jumped into a kayak in the water below.
He rowed furiously, reached a bridge, jumped out and swam to shore.
When police helicopters spotted him, his supporters jumped into the water, confused the police…and Kayak got away.

KAYAK DONATES A BIKE
Kayak is not afraid of the police. He regularly confronts them and has been arrested dozens of times.
Amongst his many arrests, Kayak was grabbed on January 25, 2011 during a tuition hike protest at UPR.
Kayak threw a bicycle at a cop…so they provided him an alternate mode of transportation.
THE TITO KAYAK LAW
In 2010, the Commonwealth added Article 208-A to the Penal Law of Puerto Rico…also known as the “Tito Kayak Law.”

Under 208-A, obstructing any work at a construction site became a felony.
The law was declared unconstitutional three years later, in Ponce Superior Court.
DEFENDING THE BEACHES
In addition to defending the Balneario de Carolina against the Marriott Hotel for over ten years, Kayak joins every struggle to protect the island’s beaches.
Just this past week, he heard that the Senate of Puerto Rico was considering a bill to privatize beaches all over the island. Kayak marched straight to the Capital Building and did this…
He climbed the northern flagpole and covered the US flag, with a hand-lettered banner that read:
“Las playas son del pueblo.”
The Senate did not pass the bill that night.
But two days later, in a follow-up protest in front of the Capital, Kayak got carried away and threatened to kill Rep. Angel Matos, the sponsor of the “private beach” legislation.
Rep. Matos filed a complaint with the San Juan DOI, and criminal charges are now under consideration.
THE RISE OF JUAN BOBO
The public significance of Tito Kayak is clear to the PRPD, the FBI, and the U.S. Dept. of Justice. That’s why Kayak was not recently arrested…
Because with a Financial Control Board around the corner, the government does not want Tito Kayak to become a “martyr,” or an island-wide symbol of resistance.
They’d rather get him on something unrelated and less noble – a parking ticket, shoplifting, urinating in public – and then throw the book at him, whether it’s true or not.
Which is why we need JUAN BOBO.
Just like El Zorro and Robin Hood, the time is now for a new legend to arise in Puerto Rico…who can speak his or her mind, and do exactly what needs to be done.
Juan Bobo is that legend.
Juan Bobo is so fearless, and his tongue is so sharp, that even the U.S. media give him great coverage.
This very week, Time Magazine asked Juan Bobo about the Financial Control Board, and this is what he said:

Thanks Tito Kayak, we love your voice. The Beautiful beaches belong to the people in those respect the land. Our “culture is being torture by the greedy. Families do not have food on their table and They are running out leaving back whatever little they had.

I own a Yak Board and named tito kayak.Every summer when I’am at the bay at Cape may,Wildwood or Atlantic City,an people ask me if my name is tito,I respond an exlain about the reasons of me naming my kayak Tito kayak,and what tito has done to help protect the environment on our island and the Caribbean They showed sympathy for tito and wish him well and also applaud me for naming my kayak after him…Iam very proud we have person’s like him! Hope one day will met him.

Raising of Puerto Rican flag at Statue of Liberty[edit]
On November 5, 2000, Tito Kayak and five other Vieques activists stepped onto the top deck of the Statue of Liberty in New York City in protest and Kayak then placed a Puerto Rican flag on the statue’s crown[1][2][3][4][5][6][7]
Carolina apartment complex protest[edit]
On March 15, 2005, Kayak chained himself to a vehicle after entering a Marriott Hotel property on a Carolina, Puerto Rico, beach to protest against the building of an apartment complex. “Like many other Puerto Ricans, they were concerned about the Courtyard Marriott Hotel’s plan to expand in an area contiguous to the terrestrial marine zone and located on a beach area used by families and workers for recreation. If the construction were allowed to continue, it would have had a substantial negative impact on the environment and make the public beach inaccessible, to non-hotel guests.”[8]
Raising of Puerto Rican flag at the United Nations[edit]
On June 13, 2005, Kayak was arrested inside the United Nations headquarters in New York City after he attempted to switch the United Nations flag with the Puerto Rican one, while the United Nations Special Committee on Decolonization discussed the political status of Puerto Rico. He was subsequently (October 11, 2013) found not guilty by a Manhattan Criminal Court judge of the filed State charge but was fined $500 for trespassing.[9]
Arrest in Israel while in support of the Palestine cause[edit]
On April 20, 2007, Kayak was arrested in Israel[10] after he climbed a surveillance tower near Israel’s West Bank separation barrier and planted a Palestinian flag in support of Palestine. Kayak spent about five hours in the tower, before climbing down. After his arrest, Kayak stated that “All I did was to express my identification with the villagers against the wall which is believed to be evil and illegal by the whole world and many leaders like Nelson Mandela, Jimmy Carter and the United Nations”.[10]
San Juan’s Paseo Caribe crane case[edit]
On November 14, 2007, Kayak climbed the construction cranes at the Paseo Caribe project in San Juan, Puerto Rico, and remained perched on the crane for one week. In a daring escape, Kayak rappelled down from the crane and unto a red kayak in the water below while police officers were kept at bay by his supporters. Tito Kayak then rowed himself under a bridge whose clearance was too low for the police powerboats and switched out of the kayak, so when the kayak was apprehended he was no longer on board. Meanwhile, he swam across to the other shore. When he was spotted by the police helicopters, supporters jumped into the water further confusing the police and facilitating Kayak’s final getaway.[11]
Commemorating David Sanes’ death[edit]
On April 14, 2009, during the anniversary celebrations of David Sanes’s death, Tito Kayak arrived at the former bombing range of Vieques, a restricted area operated by the Federal Fish and Wildlife, and painted a sign saying “Bieke or Death. The Struggle Continues” (“Bieke” was a reference to Vieques) on the former navy Operation Post (OP).[12] Sanes, a civilian Navy security guard, had died 10 years earlier victim of a U.S. Navy bomb while on duty at the Operation Post.
2010-2011 University of Puerto Rico strike activism[edit]
On January 25, 2011, Puerto Rico Police officers arrested a number of protesters who, using Civil Disobedience, attempted to bar entry and exit from the University of Puerto Rico, Río Piedras Campus, during the 2010-2011 University of Puerto Rico strikes. One of the protesters, wearing a hood, was later found to be Tito Kayak.[13]
2012 Oscar López Rivera incarceration[edit]
On 7 June 2012, Tito Kayak started a two-leg, lone high seas voyage from Ciudad Bolivar, Venezuela to San Juan, Puerto Rico, and then from San Juan, Puerto Rico to Washington, D.C., USA, to protest the U.S. incarceration of Puerto Rican political prisoner Oscar López Rivera.[14][15][16] López Rivera is said to be “among the longest held political prisoners in the history of Puerto Rico and in the world.”[17] He has been jailed for 35 years, 1 month and 4 days.[18]
Legacy[edit]
An amendment to the Puerto Rico penal code (Article 208A) is largely attributed to reaction to Tito Kayak’s protests against urban and commercial development and is commonly known as The Tito Kayak Law (even though there is no such declaration in the law itself).[19] The Law attempted to criminalize activism at construction sites.
Law 149 of 2004 was amended by Law No. 158 of 2010, adding Article 208-A[20][21] and it made it a felony enter, without authorization, a properly approved construction site for the purpose of temporarily or permanently obstructing work. It also penalized the occupation of the construction site’s associated land or equipment. Although the legislative act makes no mention of the Tito Kayak name nor exists any such designation in the amendment proper, the legislation is commonly cited in the press as “Ley Tito Kayak” (Tito Kayak Law) and has entered the local lexicon as such.[19]
In March 2013, Tito Kayak celebrated as the Law was declared unconstitutional by a Commonwealth of Puerto Rico judge sitting at the Ponce Superior Court.[

¿Qué es lo primero que nos toca después de impuesta la YUNTA? Adivinaste, las ELECCIONES. Pero estas no son como cualquiera de las elecciones anteriores. Estas son unas elecciones que pueden encaminarnos a la transición del colonialismo a la libre determinación. Los que salgan electos en estos comicios serán los intermediarios entre la YUNTA y el pueblo, pero además tendrán en sus manos el acelerar u obstaculizar el proceso de libre determinación. Por tanto, por más molestos que estemos con los partidos políticos y el gobierno, este no es el momento para la abstención electoral. Si en algún momento la abstención tuvo la fuerza moral de denunciar el régimen colonial ya es otra cosa. Ahora es necesario aunar fuerzas de los sectores no partidistas para desplazar los partidos políticos que han mal administrado la colonia. Organicemos un frente electoral no partidista para elegir candidatos que se comprometan con un programa de buen gobierno y encausen el proceso de descolonización. Basta ya de votar por los mismos partidos y esperar resultados diferentes. APUNTATE.
