The Governor of Puerto Rico continues to cry. He has just discovered that Puerto Rico is a colony…the personal property of the United States.

Gov. Garcia Padilla calls this a “shift” in US foreign policy: that until last week, Puerto Rico was an autonomous nation with its own independent government. With all due respect, the governor is either a moron or a liar.

In addition to the Territorial Clause and the Supremacy Clause of the US constitution, and in addition to the insular cases (Balzac v. Porto Rico; De Lima v. Bidwell; Goetze v. US; Dooley v. US; Armstrong v. US; Downes v. Bidwell; Huus v. New York and Porto Rico Steamship Co.) a succession of US Presidents, including Barack Obama, have issued executive orders explicitly stating the US position: that Puerto Rico is an unincorporated territory of the US.

Most interesting of all, is the case of José Trías Monge.

José Trías Monge – Chief Justice of the Supreme Court of Puerto Rico

Monge was the Chief Justice of the Supreme Court of Puerto Rico from 1974 through 1985. He was also the Attorney General of Puerto Rico, and the chief legal counsel to Gov. Luis Muñoz Marín.

Monge was the chief architect of the Commonwealth status (Estado Libre Asociado), drafter of the Constitution of Puerto Rico, and lead member of the Constitutional Convention of Puerto Rico, which ratified the constitution that Monge himself wrote.

Monge also defended the “Commonwealth” status in US congressional hearings, and before the U.N. Decolonization Committee in 1953-54.

In other words, José Trías Monge and Gov. Luis Muñoz Marín were the two Puerto Ricans most responsible for the creation of the island’s “Commonwealth” status.

For this reason, the following book is profoundly significant:

Puerto Rico:Trials of the Oldest Colony in the World was written by José Trías Monge, towards the end of his life. He had already served as Chief Justice of the Supreme Court, and Attorney General of Puerto Rico.

The book was published by the Yale University Press in 1997.

In this book, Monge wrote that the “Commonwealth” status was a complete fraud, and that Puerto Rico was a US colony.

In addition to the book’s title, every chapter inside it, discussed the colonial status of Puerto Rico.

Monge wrote:

”How can the nation most identified with the values of freedom and equality in the world keep such a shoddy political ghetto as Puerto Rico in its own backyard?”

Monge also wrote:

“There is no reason for continuing to back the status quo. Puerto Rico should cease being…a colony of the United States.”

On the flap cover of the book, the Yale University Press wrote:

“A distinguished Puerto Rican legal scholar and former government official…argues that the process of decolonization should begin immediately.”

Eighteen years later, this “process of decolonization” has yet to begin.

But now, in 2016, the time may finally have arrived.
